Terms of Service, Ticket Terms, and Liability Waiver

These Terms of Service ("Terms") govern your use of the Party on a Tuesday website, your application for and use of a ticket to any Party on a Tuesday event, and your attendance at the event itself. Party on a Tuesday is produced by Denver Social Society LLC, a Colorado limited liability company ("DSS," "we," "us," or "our").

By using our website, submitting an application, purchasing a ticket, or attending an event, you agree to these Terms. If you do not agree, please do not use the website, apply for a ticket, or attend the event.

1. Who These Terms Apply To

"You" or "Guest" means anyone who visits the website, applies for a ticket, purchases a ticket, or attends a Party on a Tuesday event, whether as a general guest, sponsor representative, vendor, performer, or otherwise. If you are attending as someone's guest using a ticket obtained by another person, these Terms apply to you too, and the person who obtained the ticket is responsible for making sure you understand and agree to them.

You must be 21 years of age or older to apply for a ticket or attend a Party on a Tuesday event. By applying, purchasing a ticket, or attending, you represent that you are at least 21 years old and will be prepared to show valid, government-issued photo ID at the door. If you misrepresent your age, we may remove you from the event without a refund, and you'll be responsible for any resulting cost or liability.

2. The Application Process

Party on a Tuesday events are curated. Requesting a ticket does not guarantee you a ticket or admission. We review applications and decide, in our sole discretion, who receives a ticket and who does not. We do this to bring together a room of people who will have a good time together, not to exclude anyone based on a protected characteristic, and a decision not to admit you is not a comment on you as a person.

If your application is not accepted, any payment you made will be refunded in full. We will let you know either way.

3. Tickets

  • Tickets are personal to the Guest named on them and are not transferable to another person unless we agree otherwise in writing.

  • Tickets cannot be resold. We may cancel any ticket we reasonably believe was purchased for resale, or obtained through a bot, scalping service, or similar means, without refund.

  • Each ticket admits one person for the date and time stated on the ticket.

  • We may require you to show your ticket and photo ID at the door and may refuse entry if the name on your ticket doesn't match your ID, or if we're unable to verify your identity.

4. Payment and Refunds

Ticket prices are stated on the website or in your application confirmation and are due at the time you accept your ticket, unless we agree to other terms in writing.

All ticket sales are final. We do not offer refunds or exchanges for change of mind, inability to attend, being asked to leave the event under Section 6, or any other reason, except:

  • if we cancel the event entirely, in which case we will refund your ticket price; or

  • if your application is not accepted under Section 2.

If the event is postponed, your ticket will be honored on the new date. If you can't make the new date, contact us and we'll work with you.

We may change ticket prices, tiers, or availability at any time before you purchase. Once you've paid, your price is locked in.

If you file a chargeback or payment dispute for a ticket that was validly issued and used, or otherwise reverse a payment without contacting us first, we may deny you entry to the event, cancel any other tickets in your name, and decline to sell you tickets to future events.

5. Event Conduct

We want everyone to have a great night. To make that possible, we ask you to:

  • Treat other guests, staff, performers, and vendors with respect.

  • Follow the reasonable instructions of venue staff, security, and event staff.

  • Follow the venue's rules along with ours.

  • Drink responsibly, especially in a room full of people.

We may refuse entry to, or remove from the event, anyone who:

  • Appears visibly intoxicated to a degree that raises safety concerns.

  • Is being violent, threatening, or harassing toward another person.

  • Is engaging in illegal activity.

  • Is otherwise creating an unsafe or seriously unpleasant environment for other guests.

If we remove you under this section, you are not entitled to a refund.

Any dress code or theme guidance for an event is meant to add to the fun, not a strict requirement for entry, unless we say so specifically for a particular event.

Weapons, illegal drugs, outside alcohol, and other items the venue or event staff consider unsafe are not permitted. We and venue security may inspect bags and refuse entry to, or remove, anyone carrying a prohibited item.

6. Lost or Stolen Property

DSS and the venue are not responsible for personal belongings that are lost, stolen, or damaged at the event, including items left at coat check or elsewhere on the premises. Keep track of your valuables.

7. Assumption of Risk

Attending a large social event with alcohol service involves some inherent risk. That can include, without limitation: crowded spaces, loud music and lighting, dancing and physical activity, alcohol consumption (by you or others), interactions with other guests you don't control, exposure to illness or communicable disease in a crowded indoor setting, and use of venue features like stairs, elevators, or outdoor areas.

By attending, you voluntarily assume these risks. You are responsible for your own decisions about how much to drink and how to conduct yourself, and for the reasonably foreseeable consequences of those decisions.

8. Release of Claims

To the fullest extent allowed by Colorado law, you release DSS, Party on a Tuesday, the event venue, our sponsors, vendors, and performers, and each of our and their owners, officers, employees, and agents (together, the "Released Parties") from any claim, liability, or expense arising from your attendance at the event, except to the extent it results from the gross negligence or intentional misconduct of a Released Party.

This release does not limit your ability to seek help from venue staff, security, or emergency services if you need it, and does not waive any right that cannot be waived under Colorado law.

9. Indemnification

You agree to indemnify and hold harmless the Released Parties from any claim brought by a third party arising from your own conduct at the event, such as an injury you cause to another guest. This does not apply to claims arising from the gross negligence or intentional misconduct of a Released Party.

10. Alcohol Service

Alcohol is served at Party on a Tuesday events by the venue or a licensed vendor under their own liquor license. Service is at the sole discretion of the venue's bartenders and staff, who may refuse service to anyone for any lawful reason. We encourage you to eat before and during the event, know your limits, and arrange safe transportation home. Do not drive if you've been drinking.

11. Photography, Video, and Media Release

Party on a Tuesday events are photographed and filmed for marketing and archival purposes. By attending, you grant DSS a perpetual, worldwide, royalty-free license to use photos and video that include your image or likeness, taken at the event, in our marketing, social media, website, and promotional materials, without additional compensation to you.

If you'd rather not appear in our marketing, let our photography team know at the event and we'll make reasonable efforts to avoid featuring you, or contact us afterward and we'll remove specific images on request where practical.

12. Sponsors and Third Parties

Some elements of the event, such as drinks, activations, or giveaways, may be provided by sponsors or third-party vendors. We select sponsors carefully, but we don't control their products or services and aren't responsible for them beyond what's stated in this section. Any interaction you have with a sponsor's product, service, or promotion is between you and that sponsor.

13. Website Use

The Party on a Tuesday website and its content, including text, graphics, logos, and photos, is owned by DSS or our licensors and is protected by copyright and trademark law. You may view and share it for personal, non-commercial purposes, but you may not copy, reproduce, or use it commercially without our written permission.

You agree not to use the website to submit false information, attempt to access it in an unauthorized way, interfere with its operation, or use it for any unlawful purpose.

The website may link to third-party sites we don't control. We aren't responsible for their content or practices.

14. Electronic Communications

By applying for a ticket or using the website, you agree to receive email from us, including ticket confirmations, event details, and marketing about future Party on a Tuesday events. You can unsubscribe from marketing email at any time using the link in that email, though we may still send you transactional messages related to a ticket you've purchased.

15. Privacy

Information you submit through the website or your ticket application is handled under our Privacy Policy [LINK], which explains what we collect and how we use it.

16. Disclaimers

The website and the event are provided "as is." We don't guarantee the website will be error-free or uninterrupted, and we don't guarantee any particular outcome from attending the event, for example that you'll make a specific connection or business outcome. Party on a Tuesday's philosophy is about creating the conditions for great relationships and conversations; we can't promise a particular result for any individual guest.

17. Limitation of Liability

To the fullest extent allowed by Colorado law, DSS's total liability to you for anything arising from these Terms, the website, or the event is limited to the amount you paid for your ticket. DSS is not liable for indirect, incidental, or consequential damages.

Nothing in these Terms limits liability that cannot be limited under Colorado law, including liability for gross negligence, willful misconduct, or death or bodily injury caused by a Released Party's negligence to the extent Colorado law prohibits limiting it.

18. Dispute Resolution

18.1 Let's Talk First

If you have a problem, contact us at hello@denversocialsociety.com and give us a chance to make it right before filing any claim.

18.2 Arbitration

Except for a claim that qualifies for small claims court, in which case either of us may go there instead, any dispute arising out of or relating to these Terms, the website, or an event will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, conducted in Denver, Colorado. The arbitrator's decision is final and binding, and can be entered as a judgment in any court with jurisdiction.

18.3 Class Action Waiver

Disputes will be brought only on an individual basis, not as a class, collective, or representative action. The arbitrator has no authority to combine more than one person's claims or to preside over any form of representative or class proceeding.

18.4 Severability of This Section

If any part of this Section 16 is found unenforceable, the rest of it still applies, except that if the class action waiver is found unenforceable, the entire arbitration requirement in this section is void and disputes will instead be resolved in the courts described in Section 17.

19. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles. If Section 16's arbitration requirement doesn't apply for any reason, you agree that the state and federal courts located in Denver, Colorado have exclusive jurisdiction.

20. Force Majeure

We aren't responsible for a failure to hold the event, or a change to its date, time, or venue, caused by circumstances beyond our reasonable control, including severe weather, venue closure, government order, public health emergency, or similar events.

21. Changes to These Terms

We may update these Terms from time to time. The version posted on our website at the time of your application, ticket purchase, or event attendance applies. We'll post the effective date at the top of this document.

22. Assignment

We may assign or transfer these Terms, in whole or in part, without your consent, including in connection with a sale, merger, or restructuring of DSS or the Party on a Tuesday brand. You may not assign your rights under these Terms without our written consent.

23. No Waiver

If we don't enforce a provision of these Terms on one occasion, that doesn't waive our right to enforce it later.

24. Severability

If any part of these Terms is found invalid or unenforceable, the rest remains in full force and effect.

25. Entire Agreement

These Terms, together with our Privacy Policy and any event-specific details in your ticket confirmation, are the entire agreement between you and DSS regarding the website and the event, and replace any earlier agreements on the same subject.
